Terms and Conditions

Every purchase from our web store is considered a server donation. By donating to Explorer's Bay you are not entitled to any physical or virtual good, a donation is a donation and not a purchase. Please note that ranks are the only permanent purchases. Everything else, including Keys, Crates, Perks and Items and more items are gamemode specific and not guaranteed if the server should reset.

All items from our store can also be purchased in game using Explorer Bay Bucks - which is a virtual currency. Bucks are earned through voting, events and more. Please see our discord, in game guide or ask staff for more information. Some items or perks can also be purchased in game using vote points or in game gold. 

As defined earlier, a donation is an act or instance of presenting something as a gift, grant, or contribution with no expectation of anything in return. Anything received will be as is and with no warranty or guarantee item(s) will always be available or remain the same. Changes may occur due to future updates or plugin changes etc. We cannot guarantee every package or item will remain in the shop or in the game. 

All terms and conditions are in effect indefinitely as soon as the contract is accepted, and will remain to be active even after you quit, are banished, removed, or if you leave the server in any way.

Reserved Rights:

We reserve the right to change, with or without notice, any pricing, benefits, perks, rewards, commands, etc. of any ranks, plugins or services.  
The rank benefits, crates and other donation shop items or perks may change at any time without notice. 

We reserve the right to change, with or without notice any rules on Explorer's Bay.

You will not abuse your items, permissions, and/or ranks.

All items are virtual goods and have no value, cannot be sold back to the server or traded back. 

You cannot transfer your items, permissions or ranks to another account - even if it is owned by yourself.

We reserve the right to ban you without notice if you are breaking the rules of the server. You will not be refunded. All bans are subject to a full discretion of Explorer's Bay staff team.

Inactive players that are away and inactive from the server 90 days or more will lose their claims and belongings. This player data is reset at 90 days. We are not responsible if you lose your items due to inactivity. It is up to you to log in within this time to keep your account and belongings active.

We can make any edits to the items you have purchased at any point.

There is no guarantee on being able to join the server, and if the server and/or purchased it or feature is no longer in operation, the virtual items are to be voided. 

Refund requests due to issues concerning lag, game glitches, or any other issues are subject to the discretion of Explorer's Bay staff team. Please make a ticket in discord. 

If you have any issues, please make a ticket in our discord - this notifies the entire staff team, including owners and management. The sooner we are aware of an issue, the sooner we work on finding a fair resolution.

Disclaimer: 

By reading these Terms & Conditions, you are acknowledging that all items purchased, that are not perks, ranks or command are for a map only. Meaning that they will be lost upon a reset on the server.

Legal Actions:

You agree to indemnify the owner, staff, hosts, partners, and all other parties related to the server staff.  By agreeing to these terms, you agree not to present any lawsuit or other legal challenge against the server staff, whether related to your purchase or not.  

You understand and agree that the use of this website, server, or any other content is made available and provided to you at your own risk.  We disclaim all warranties of any kind, expressed or implied, including but not limited to warranties of merchant-ability, fitness for a purpose, and non-infringement.  You use all information and services at your own risk without our liability of any kind.

By accepting the terms of this document, you waive your right to take any action, legal or otherwise, against anyone or anything related to the server, website, staff and administration, members, or any other services relating to this server.  You also acknowledge that if any part of this document is found to be invalid or unenforceable in any way, any parts found to be invalid or unenforceable will be considered fully valid and legally binding. 

You understand and agree that we shall not be liable for any direct, indirect, incidental, special, exemplary, accidental, or consequential damages resulting from the use or inability of any services, unauthorized action to or alteration of your data, statements or conduct of any third party on the service, or any other matter relating to the server or the service. You may not take any legal actions towards us if this was to happen.

Refund Policy: 

All sales are final, you may not buyback, trade, credit the server by any means necessary in order to receive your funds back that of which have been paid. In doing so we reserve the right to disallow your continued play on the server/Discord® and not allow further funds to be added or taken away. We reserve the right to pursue any legal or collection action necessary to recover damages or fees in the event of a forced charge-back.
